Terms of Service

1.Who you are contracting with

Animboards ("the Service") is operated by Piotr Sawicki, trading as Motion Factory, a sole trader registered in Poland ("we", "us").

Payments are processed by Paddle.com Market Ltd, which acts as the merchant of record. When you buy credits, your contract of sale is with Paddle, and Paddle issues your invoice and handles tax. Paddle's own terms and refund policy apply to the payment alongside these terms, and where they conflict on matters of payment, Paddle's terms govern.

2.What the Service does

Animboards turns scripts and prompts into storyboards, reference sheets, style frames, animatics and video shots, using third-party AI models. Output is generated automatically and we do not review it before you see it.

3.Accounts

You need an account to generate anything. You must give a working email address, keep your credentials secure, and are responsible for activity under your account. Accounts are for one person; do not share logins.

The Service is not for children. You must be at least 16 years old to hold an account. If you are under 16, ask an adult to hold the account and use the Service on your behalf.

You may delete your account at any time from the “Your data” page. Deletion takes effect 14 days after you ask, so that a mistake can be undone; during those 14 days the account works normally and one click cancels it. Unspent credits are not refunded on deletion, so ask for a refund first if you want them back.

New accounts receive a one-off grant of free credits, valid for 30 days from signup. It is a promotional gift: it has no cash value, it is never refundable in money, and it may be withdrawn or changed for future signups at any time. Credits you buy are separate, last 90 days, and are spent only once any free credits are gone.

4.Credits

Generation is paid for with credits, bought in advance in packs. Each operation costs a stated number of credits, shown before you start it. Prices in credits may change; the price shown at the moment you generate is the one charged.

Credits are debited before the work is sent to the AI provider. If a generation fails for a technical reason, the credits are returned to your balance automatically.

Credits have no cash value except as set out in section 6, cannot be transferred between accounts, and cannot be exchanged for money outside a valid refund.

Credits bought in a pack expire 90 days after purchase. We email you a week before that happens, to the address on the account.

Where you hold credits with different expiry dates, the ones expiring soonest are spent first. Credits that are still unspent when you close your account are lost: ask for a refund before deleting the account if you want the money back instead.

5.Subscriptions

Plans renew automatically at the end of each billing period until cancelled. The price and period are shown before you subscribe and on the receipt Paddle sends you.

Each month grants that plan's allowance. Unused credits carry over one month only: an allowance granted in March can be spent in March and April, and lapses when May begins. Annual plans are billed once but deliver the same monthly allowance. You pay a year up front at a discount and receive credits month by month, on the same terms.

You may cancel at any time, through the receipt Paddle emailed you or by contacting us. Cancelling stops future renewals; you keep access and any credits already granted until they expire on the schedule above. We do not refund the current period on cancellation, because its allowance has already been granted.

If we change a plan's price or allowance, we will give at least 30 days' notice and the change takes effect at your next renewal, not mid-period.

6.Refunds and your right to withdraw

If you are a consumer in the EU or UK, you normally have 14 days to withdraw from a distance purchase. Before checkout you are asked to confirm the following, and we record that you did:

“I ask for my credits to be made available immediately, before the 14-day withdrawal period ends. I understand that credits I have already spent cannot be refunded, and that my right to withdraw within 14 days applies only to credits I have not used.”

Our policy follows from that:

  • Unused credits, within 14 days of purchase. Full refund of that purchase, no reason needed.
  • Partly used credits, within 14 days of purchase. Pro-rata refund for the credits you have not spent.
  • After 14 days, or for credits already spent. No refund. Spent credits have already been paid to the AI providers on your behalf.

Request a refund by contacting us or Paddle. Because Paddle is the merchant of record, it may also grant a refund at its own discretion; where it does, we remove the refunded credits from your balance. If you had already spent some of them, your balance simply goes to zero. We do not put an account into debt.

Nothing here limits any statutory right you have that cannot be excluded by agreement.

7.Your content and what you may do with the output

You keep all rights in the scripts, prompts, images and other material you upload ("Input"). You grant us only the licence needed to run the Service: to store your Input and pass it to the AI providers that generate your output.

As between you and us, you own the material the Service generates from your Input ("Output") and may use it commercially, including in client work.

Two limits we cannot remove. First, AI output may not be protected by copyright in some jurisdictions, so we cannot promise it is exclusively yours. Second, similar prompts can produce similar results for other users, so we cannot promise your Output is unique. If you need guaranteed exclusivity, do not rely on generated material alone.

You are responsible for having the rights to whatever you upload, and for checking that your Output does not infringe anyone else's rights before you publish it.

8.Acceptable use

You may not use the Service to create or attempt to create:

  • sexual content involving minors, or any child sexual abuse material;
  • content that harasses, defames or impersonates a real person;
  • content depicting a real, identifiable person without their consent;
  • material that infringes copyright or trade marks;
  • content that is illegal where you are, or where it will be published.

You also may not resell access, attempt to bypass credit limits, automate the Service beyond the interfaces we provide, or copy, decompile or reverse engineer any part of it in order to build a competing service. We may suspend or close accounts that break this section; where we do so for a serious or repeated breach, unused credits are forfeited.

9.AI transparency and labelling

The Service is an AI system: the frames, animatics, voice-overs and video it produces are generated by third-party AI models from your Input. Everything you export is marked as machine-made. Exported stills, videos and PDFs carry provenance metadata that identifies the file as AI-generated (the IPTC digitalSourceType valuetrainedAlgorithmicMedia), which is how platforms and tools detect synthetic media. Removing or altering that marking is not permitted.

You can additionally burn a visible label into an export from the export dialog. It is the European Commission's AI mark, placed in a corner of the frame. Whether the result is fully generated or combines your own images and footage with generated material is recorded in the file's metadata.

When you publish the Output, the disclosure duties are yours as the person publishing. Under the EU AI Act, content that resembles real people, places or events and could be taken for genuine recording must be disclosed as artificially generated; for evidently artistic, creative, satirical or fictional work, it is enough to disclose the presence of generated content in a way that does not spoil the work. Platforms may also have their own rules for synthetic media. We give you the tools; we cannot make the declaration for you.

10.Where your boards are stored

Your boards, generated images, audio and video are currently stored in your own browser, not on our servers. They are not backed up by us, are not visible to us, and are lost if you clear your browser data or switch device.

Export anything you need to keep. We are not liable for boards lost this way. If we move storage to our servers in future, we will tell you before we do.

11.Availability

The Service depends on third-party AI providers and may be unavailable, slow or degraded for reasons outside our control. We do not promise any level of uptime. We may change or discontinue features; if we discontinue the Service entirely, we will give reasonable notice and refund unused credits.

12.Liability

The Service is provided as-is. To the extent the law allows, we exclude liability for indirect or consequential loss, lost profits, lost business, and lost or corrupted data.

Where liability cannot be excluded, it is limited to the amount you paid us in the 12 months before the claim.

Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. If you are a consumer, your statutory rights are unaffected.

13.Changes to these terms

We may update these terms. For material changes we will give at least 14 days' notice by email or in the app. Continuing to use the Service after that means you accept the change; if you do not, you may stop using it and request a refund of unused credits.

14.Law and disputes

These terms are governed by Polish law. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may bring proceedings there.

Consumers in the EU may also use the European Commission's online dispute resolution platform.
